These Terms and Conditions (“Terms”) govern your access to and use of www.bedmodco.com (the “Site”). The Site may contain links to products offered through third-party marketplaces, including Amazon. Your use of those marketplaces and any purchases made through them are also subject to the applicable marketplace's terms and policies. By accessing or using the Site, you agree to these Terms.

1. Products and Availability

We make reasonable efforts to ensure that product descriptions, images, specifications, pricing, and other information displayed on the Site are accurate and current. However, information may occasionally contain errors or omissions and may be updated without notice. Product availability is not guaranteed and may vary by marketplace. Product descriptions and other information provided on the Site are for general informational purposes only and are not intended as medical or health advice. 

2. Purchases

BedMod Co. does not currently process purchases directly through this Site. Product links may direct you to third-party marketplaces, including Amazon. Purchases made through a third-party marketplace are subject to that marketplace's applicable terms, payment policies, shipping policies, and return/refund policies. 

3. Pricing and Payment

All prices displayed on the Site are listed in USD unless otherwise indicated and are subject to change without notice. Prices displayed on the Site are for informational purposes. For purchases made through a third-party marketplace, the price, taxes, fees, payment terms, and other transaction details displayed by that marketplace at the time of purchase govern the transaction. 

4. Shipping

Orders purchased through Amazon or another third-party marketplace are fulfilled and delivered according to the applicable marketplace's shipping and delivery policies. BedMod Co. is not responsible for shipping estimates, carrier delays, delivery errors, or other fulfillment matters controlled by the applicable marketplace or carrier, except to the extent required by applicable law. 

5. Returns and Refunds

Returns, refunds, and exchanges for purchases made through Amazon or another third-party marketplace are governed by the applicable marketplace's policies and should be initiated through the marketplace through which the purchase was made. 

6. Intellectual Property

The Site and its original content, including text, graphics, logos, photographs, images, designs, trademarks, branding and other materials, are owned by BedMod Co. or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit such content without our prior written permission, except as permitted by applicable law. 

7. User Conduct

You agree not to use the Site for any unlawful purpose or in any manner that could damage, disable, overburden, impair, or interfere with the Site or another person's use of the Site. You may not attempt to gain unauthorized access to the Site, its systems, or networks, or use automated means to scrape, copy, or extract Site content except as permitted by law.  

8. Disclaimer of Warranties and Limitation of Liability

To the fullest extent permitted by applicable law, this Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components. BedMod Co. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or products purchased through a third-party marketplace. Nothing in these Terms excludes, restricts, or limits any warranty, liability, remedy, or consumer right that cannot lawfully be excluded, restricted, or limited. 

9. Third-Party Websites and Marketplaces

The Site may contain links to third-party websites or marketplaces, including Amazon. These third parties operate independently from BedMod Co., and we do not control their websites, policies, content, availability, or services. Your use of a third-party website or marketplace is subject to that third party's applicable terms and policies. 

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles, except where applicable consumer protection laws require otherwise. 

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Effective Date” at the top of this page. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

12. Severability

 If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

13. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

14. Entire Agreement

These Terms, together with any policies expressly incorporated by reference, constitute the entire agreement between you and BedMod Co. regarding your use of the Site.
